Our Terms & Conditions For Kayaking
Booking and Payment
– All bookings must be made in advance via our website or by contacting our booking team.
– If the tour is cancelled by the customer less than 96 hours before the departure time, no refund will be provided.
– Any cancelations outside the 4 day period will receive a refund of 80%
Safety and Responsibilities
– Children under the age of 16 must be accompanied by a responsible adult.
– All participants must wear provided safety gear, including life jackets, during the tour. Failure to do so will result in exclusion from the tour.
– Our Qualified guides will conduct a brief safety briefing before departure, which must be followed at all times.
– By participating in the kayaking tour, you acknowledge that there are inherent risks involved in kayaking, such as but not limited to capsizing, injury, or drowning. You accept these risks and agree to follow all instructions given by the tour guides.
– Participants must not be under the influence of alcohol or drugs while taking part in the tour.
– Any participant who demonstrates reckless behavior or does not comply with safety guidelines may be asked to leave the tour with no refund.
Tour Cancellations and Rescheduling
– Company Cancellation: We reserve the right to cancel or reschedule a tour due to extreme weather conditions, unforeseen events, or other safety concerns. In the case of a cancellation by the company, we will offer a full refund or an alternative tour date.
– If the tour is cancelled by the customer less than 96 hours before the departure time, no refund will be provided. Any cancelations outside the 4 day period will receive a refund of 80%
– In the event of a rescheduled tour, customers may choose an alternative date, subject to availability.
Liability
– By booking and participating in a kayaking tour, you release and discharge Kayking Sydney and its employees, agents, and affiliates from any liability for personal injury, loss, or damage to property, except where caused by negligence or breach of statutory duty by the company.
– You agree to indemnify the company against any claims made by third parties arising from your participation in the tour.
Equipment
– All kayaks, paddles, life jackets, and other necessary equipment will be provided by us. You are responsible for the proper use and care of the equipment during the tour.
– If any equipment is damaged or lost during the tour, the participant may be liable for the cost of repair or replacement.
– Participants are encouraged to bring their own water bottles, sunscreen, and other personal items necessary for the tour.
Health and Fitness
– Participants must be in good physical health and have the necessary fitness level to engage in kayaking for the duration of the tour
– It is the responsibility of the participant to inform us of any medical conditions, allergies, or special needs prior to booking or before the tour begins.
Personal Belongings
– Participants are responsible for their personal belongings during the tour. The company is not liable for lost or stolen items.
– We recommend securing valuables such as phones, wallets, and cameras in waterproof bags or leaving them onshore.
Privacy and Data Protection
– We are committed to protecting your privacy and will handle your personal data in accordance with Australian privacy laws.
– By booking with us, you consent to us using your personal details for booking and communication purposes. We will not share your information with third parties without your consent, unless required by law.
Photography and Marketing
– During the tour, we may take photographs and videos for promotional purposes. If you do not wish to be photographed or filmed, please inform your tour guide before the tour begins.
– By participating in the tour, you agree that any photographs or videos taken may be used in our promotional materials, including on our website and social media platforms.
Governing Law
– These terms and conditions are governed by the laws of New South Wales, Australia, and any disputes will be resolved under the jurisdiction of the courts of New South Wales.
Acceptance of Terms
– By booking and participating in our kayaking tour, you agree to abide by these Terms and Conditions.
– Any participant who demonstrates reckless behavior or does not comply with safety guidelines may be asked to leave the tour with no refund.

Blues Point Reserve, (End of Blues Point Road) McMahons Point 2060, Australia
Please use Blues Point Road, McMahons Point as your drop-off. We launch from next to the car park, there is usually 4 hours free street parking available around the Blues Point Reserve. There are public toilets nearby as well.
