Welcome to Kayaking Sydney. By booking or participating in any of our kayak tours, you agree to the following Terms & Conditions. These terms are designed to ensure a safe, enjoyable, and professional experience for all participants.

Safety and Responsibilities
Tour Cancellations and Rescheduling
Kayaking Sydney may cancel or reschedule tours due to adverse weather conditions, unsafe water conditions, or other circumstances beyond our control. In the event that we cancel a tour, customers will be offered either a full refund or the opportunity to transfer their booking to another available date. Requests to reschedule a booking should be made at least 96 hours before the scheduled departure and are subject to availability.
Liability
Kayaking is an outdoor adventure activity that carries inherent risks. By participating in one of our tours, guests acknowledge and accept these risks. While Kayaking Sydney takes every reasonable precaution to ensure a safe and enjoyable experience, we cannot accept responsibility for any injury, illness, loss, or damage incurred during participation, except where required by applicable law. All participants agree to take part at their own risk and to follow the directions of our guides at all times.
Equipment
Kayaks, paddles, life jackets, and all other equipment supplied by Kayaking Sydney remain the property of the company and must be used responsibly. Participants are expected to treat all equipment with care and immediately report any damage or faults to a member of our team. Guests may be held responsible for repair or replacement costs if equipment is intentionally damaged or used negligently.
Health and Fitness
Participants should be in good general health and possess a reasonable level of fitness suitable for kayaking. Any medical conditions, injuries, or physical limitations that may affect safe participation should be disclosed before the tour begins. Kayaking Sydney reserves the right to refuse participation if we believe a guest’s health or fitness could pose a safety risk to themselves or others.
Personal Belongings
Participants are responsible for their own personal belongings throughout the tour. While every effort is made to provide a safe environment, Kayaking Sydney accepts no responsibility for lost, stolen, or damaged items, including mobile phones, cameras, jewellery, or other valuables. Guests are encouraged to bring only essential belongings and use waterproof storage where appropriate.
Privacy and Data Marketing
During our tours, photographs and videos may be taken by our guides for promotional and marketing purposes. By participating, guests consent to the use of these images on the Kayaking Sydney website, social media platforms, and other promotional materials. If you do not wish to appear in photographs or videos, please notify our team before the tour commences.
Governing Law
These Terms and Conditions are governed by the laws of New South Wales, Australia. Any disputes arising from your booking or participation in a Kayaking Sydney tour will be subject to the exclusive jurisdiction of the courts of New South Wales.
Acceptance of Terms
By making a booking or participating in any Kayaking Sydney tour, you confirm that you have read, understood, and agreed to these Terms and Conditions. Your continued participation constitutes acceptance of these terms, and failure to comply with them may result in refusal of service or removal from the tour without refund.
